1. Background Check Consent

By clicking “I Agree” and proceeding with purchase, you voluntarily consent to a background check conducted by a third-party Background Check Provider (“BCP”) selected by Roamate. This screening may include identity verification and a review of certain public records such as criminal databases, sex offender registries, and related sources.

Cleared to Roam is voluntary and not required to access core Service functionality (e.g., creating an account, browsing, or viewing profiles).

Regional note – EU/EEA/UK: In the UK, a criminal-records component may be offered on the basis of your explicit consent under the Data Protection Act 2018 Schedule 1 (Condition: Consent).

2. Limited Purpose – Not a Consumer Report

Roamate is not a consumer reporting agency under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). This screening is solely for Roamate’s internal verification purposes. It is not a certification of safety, trustworthiness, or character, and cannot be used for employment, housing, credit decisions, or other protected uses.

3. No Guarantee of Accuracy

Roamate makes no promises or guarantees about the accuracy, completeness, or timeliness of the background check. Reports may contain errors, omissions, expunged records, outdated information, or sealed data. Roamate has no control over the content or scope of third-party screening results.

If you believe a result is inaccurate or outdated, you must contact the BCP directly. Upon notice from the BCP of a correction, Roamate will reassess your Cleared to Roam status.

Before initiating the check, you will see a conspicuous summary of disqualifying conviction categories (see §7) and the non-refund policy (see §8). By proceeding, you represent that none of the listed disqualifying categories apply to you and understand that denial based on those categories does not entitle you to a refund.

4. Not a Safety Guarantee

Cleared to Roam is a limited verification tool, not a safety guarantee. It does not mean a user has no criminal history or that they will not commit unlawful, unsafe, or harmful acts in the future.

Roamate does not screen for current behavior, addiction, sobriety, contraband possession, customs compliance, or travel law violations.

5. Badge, Validity, and Feature Access

  • If you pass, a Cleared to Roam badge will be displayed on your profile.
  • Cleared to Roam is valid for 12 months from the date of issuance.
  • After 12 months, your badge will automatically expire. To maintain Cleared to Roam status, you must repurchase and complete a new background check annually. Roamate may, but is not obligated to, notify you before badge expiry to remind you of the option to renew.
  • Roamate may, at its discretion, make certain trust-enhancing features (e.g., visibility filters, community recommendations) available only to verified users.

6. Withdrawal of Consent and Expiry

  • You may withdraw consent at any time in Settings.
  • Upon withdrawal or expiry, Roamate will remove your badge and cease displaying your verification status.
  • Roamate aims to remove the badge within 30 days of withdrawal or expiry, subject to legitimate retention needs (e.g., fraud prevention, legal obligations).

7. Screening Criteria and Disqualification

You will be automatically disqualified if your background check reveals convictions for any of the following, at any time:

  • Violent crimes
  • Sexual offenses
  • Crimes against children
  • Financial fraud, identity theft, or related crimes
  • Stalking or harassment
  • Weapons-related offenses
  • Burglary or home invasion
  • Drug-related felonies

Minor non-violent misdemeanors may be acceptable only if the offense occurred more than seven (7) years ago. Traffic violations and non-safety-related infractions do not affect eligibility.

Denial of Cleared to Roam is final, non-negotiable, and not subject to appeal.

8. Non-Refundable Payment

8.1 General Rule.

Fees are charged when a check is initiated and are final, non-cancellable, and non-refundable once submitted to the BCP.

8.2 Exceptions.

  • Where required by applicable law;
  • Where required by Apple App Store or Google Play policies; or
  • If the check cannot be completed due to provider/system issues.

8.3 Outcome Clarification.

Denial, revocation, or non-issuance of Cleared to Roam based on §7 is not a defect in the service and does not entitle you to a refund.

8.4 EEA/UK Notice.

If you are in the EEA/UK, by proceeding you request immediate performance and acknowledge that once the check has begun you may lose your statutory withdrawal right, except where non-waivable rights apply.

9. Assumption of Risk and Waiver of Liability

  • By participating in Cleared to Roam and using the Roamate platform, you knowingly and voluntarily assume all risks associated with interacting with other users, whether Cleared to Roam verified or not.
  • You understand that Cleared to Roam is not a promise of safety, trust, good character, or lawful behavior.
  • You release and hold harmless Roamate, its affiliates, employees, officers, and agents from any and all liability related to Cleared to Roam, including but not limited to negligent screening, failure to prevent harm, or acts/omissions of other users.

10. Binding Arbitration and Dispute Resolution

Any dispute arising from Cleared to Roam, including eligibility decisions, is subject to binding individual arbitration under Section 18 of Roamate’s Master Terms of Service. No class actions, collective claims, or jury trials are permitted.

11. Data Retention

Roamate personnel may view limited underlying public-records details inside the provider’s secure portal solely to confirm that the provider’s decision aligns with our published criteria. Screenshots, exports, or local copies are prohibited. Access is logged and periodically reviewed.

Roamate does not receive bulk datasets or store underlying records or biometrics.

We retain only pass/fail status and a verification timestamp.

In the EEA/UK, criminal-records processing is restricted by law. In the UK, a criminal-records component may be offered only on the basis of explicit, freely-given consent, which you may withdraw at any time.

12. Governing Law

These Cleared to Roam Terms shall be governed exclusively by the laws of the Commonwealth of Pennsylvania, USA. Disputes are subject to the arbitration provisions and dispute resolution procedures set forth in Section 18 of the Roamate Master Terms of Service.
